Residence in the Provincial territory or any other Italian locality by a foreigner and the exercise of an economic activity for a period lasting over 90 days are subject to a regulation of the legal position.
Recognition of a non Italian citizen is linked to his or her residence permit or card of residence. Applications for the issue of a residence permit for stays of over 90 days, its renewal and the issue of the residence card and revision of data must be presented to the Commissariat competent for residence or to the immigration office of the Questura (Police Headquarters) in cases where no Commissariat is present.
Application for issue of a residence permit is to be made within 8 working days of entry to the country.
Citizens of the European Union who intend to establish themselves in Italy to carry out a working activity or to follow a course of studies have the right to apply for a card of residence.
Non-European Union citizens can apply for the card if:

1. they have been living here regularly for 6 years;
2. at the moment of application they are in possession of a residence permit that sanctions an unfixed number of renewals (employees for indeterminate periods of time, self-employed, family, religious reasons if this pastoral work is for unfixed periods of time, etc.);
3. they have an income sufficient for their own maintenance and that of their family living with them;
4. they have not been put on report and remanded to justice for serious crimes.

Documents necessary to obtain residence permit
In order to be issued with a residence permit the foreign person must present:

• The application form, valid passport or other equivalent document with the relative entry visa where necessary and a photocopy of this document;
• Four recent passport sized photographs bearing a good likeness, a €14,62 stamp and the documentation required on the basis of the type of residence permit needed.

Residence permit for employees
It is necessary to present:

• An undertaking of work with the employer’s authenticated signature;
• State of service or a report of the working relationship with the INPS;
• 4 passport sized photographs, a €14,62 stamp, passport and relative photocopies.

Residence permit for the self-employed
It is necessary to present:

• VAT number;
• Enrolment on the Registro Esercenti Commercio (Roll of Traders);
• Permission from the city council for the type of activity if necessary;
• 4 passport sized photographs, a €14,62 stamp, passport and relative photocopies.

Residence permit for family reasons
In order to present the application it is necessary to include:

• Wedding certificate, translated and endorsed by the Italian Consulate Representative abroad, if the certification comes from a country that does not belong to the European Union;
• Declaration that the spouse is dependant.

The application for authorization, complete with all further documentation to be included following the indications contained in the form to be presented, is to be sent to the Direzione Provinciale del Lavoro competent for the place in which the activities of work will be carried out.
